| 商业秘密的法律保护不宜也不应当只通过适用反不正当竞争法来进行，而主要应当通过民事法律来保护，即采用私法保护模式。在充分论证商业秘密民法保护的可行性的基础上，从理论模式和制度模式两方面探寻商业秘密最恰当的民法保护模式，提出主要应当选择财产权理论作为商业秘密民法保护的理论基础，商业秘密权作为无形财产权的一种与物权相并列。 |

| Business secrets should not only be protected by anti unfair competition law, but also be protected by civil law. Based on comprehensive analysis on the feasibility of protecting business secrets by civil law, and to find out the most suitable protecting mode from the aspects of theory and system, this paper propose that the property right theory should be viewed as theoretical base of protecting business secrets by civil law, and business secret right viewed as a kind of intangible property right should be juxtaposed with property right. |
