| 在阐述国外宪法有关私有财产权保护制度的基础上，指出我国宪法因体制等方面的原因致使公共财产的优势地位过分强烈，私有财产权的基本权利地位及人权属性等没有得到彰显，存在着对私有财产权保护的不足。通过比较研究，提出了完善我国私有财产权宪法保护制度的思路：我国宪法应确立私有财产权的宪法地位，并将其纳入公民的基本权利体系，明确确立征收、征用的正当程序原则。 |

| This article elaborated the constitutional protection of private property rights of foreign systems, pointed out that the obvious advantages of China's public property due to the institutional aspects of the constitution. The status of the fundamental right and the privilege of private property rights has not been reflected, the protection of private property rights in China is insufficient. Through a comparative study, the paper presents that in our constitution the constitutional status of private property rights should be established, and this right should be put into the system of fundamental rights of citizen. China's constitution should clearly establish the principle of levy and requisition so as to complete the constitutional protection of private property rights. |
