| 网络技术的发展为版权人带来机遇的同时，也使得网络侵权行为越来越“大众化”。明确网络服务商的合理注意义务，有利于实现网络环境下各方主体的利益平衡。实践中，法律对于不同类型的网络服务商要求其承担的合理注意义务也不尽相同，在特定条件下将有限的主动审查义务赋予搜索引擎服务商符合利益平衡的原则。借助立法制定更能适应高科技环境下版权保护和利益平衡需要的新规则，是未来版权法发展的趋势。 |

| The development of network technology brings opportunities to copyright owners and also makes internet infringement more and more popular. Clearly stipulating the provisions about the reasonable duty of care of the internet service providers is beneficial to achieving the balance of interests under the network environment. In practice, different internet service providers assume obligations in different ways. Requiring the internet service providers to shoulder the examining duty is in line with the principle of balancing the interests under certain conditions. To create new rule which meets the requirements of copyright protection and balance of interests is the development tendency of copyright law in future. |
