| 作为衡量公共利益的准则，公共利益的认定标准应当遵循确定性、严谨性、可操作性等原则，并与公共利益的概念和认定方法、认定原则、认定程序区别开来。公共受益性是公共利益的首要标准，包括公共利益受益主体的普遍性、受益内容的共同性、供给主体的统一性等方面。同时，公共利益能为社会公众亲身体会和直接享受，具有具体的实质性内容，符合实质性受益标准。当公共利益受到损害时，整个社会秩序都会受到侵害，全体社会成员也都会受到相应的损失，因而要从全局性、整体性角度考量利益诸要素。另外，对于公共利益的判断，不能只顾眼前的需要，而是要从社会整体长远的发展需要出发，要符合可持续发展要求。 |

| Public interest standards as a measure of public interest should follow the principles of certainty, rigor and easy operation, and they should be distinguished from the concept of public interest and from its defining methods, principles and procedures. Public benefit is the primary criterion of public interest, including universal main beneficiaries, common benefit content, and unified benefit suppliers. Meanwhile, public interest can be experienced and enjoyed directly by the public, with real benefits and in line with substantial benefit standards. When the public interest is damaged, the entire social order will be violated, and all members of society will suffer a corresponding loss. Therefore, all the elements have to be taken into consideration for the sake of the comprehensiveness and integrity of public interest. In addition, public interest should not be determined based on immediate needs, but on overall long term community development needs, on whether they meet the requirements of sustainable development. |
