| 刑法意义上的网络淫秽物品传播行为是指：在网络中上传、转发淫秽电子信息或是在提供网络接入、软件平台等网络中间服务过程中未有效履行法定监督控制义务，致使淫秽电子信息在网络中进一步扩散的行为。在对网络淫秽物品行为的监管中应注重有效控制和保护技术发展的原则，相关部门应进一步明确网络服务提供商的具体监督责任和义务，同时建立淫秽信息传播行为通报机制，实行通知强制移除制度。 |

| In the sense of criminal law, spreading pornographic materials is defined as uploading, forwarding, or failing to fulfill its legal obligations on supervision when providing internet services, and causing pornographic materials spreading widely. In the process of administrative monitoring of the pornographic materials spreading on the Internet, the efficacious controlling to the spreading and protecting the development of IT technology should be taken into account at the same time. Relevant departments should clarify service providers’ specific supervision duties and obligations, while at the same time establish a mechanism for registering and reporting the events of spreading pornographic materials which should be mandatorily removed after notice. |
