      2015年《中华人民共和国促进科技成果转化法》的修订,将作为无形国有资产的科技成果的处置权下放给各高等学校、科研院所,取消了以科技成果转化为目的处分科技成果知识产权须向主管部门、财政部门申请批准与备案的行政程序。但是,由于财政部、中国科学院、教育部、工业和信息化部尚未按照这一法律修订各自管理范围内相应的国有资产管理制度,使得各科研院所与高等学校的国有资产管理部门与科技成果转化机构之间无法尽快建立相互协调的工作机制,进而迟滞了科技成果转化工作的进程。从科研行政管理的角度出发,以法律的规范性研究为路径,发现科教单位的国有资产管理与科技成果转化制度之间存在法律规范、管理制度、法律责任不协调问题,应以《中华人民共和国促进科技成果转化法》的修订实施为导向调整现行事业单位的国有资产管理制度。
英文摘要:
      The national regulation of Promoting the Transfer of Scientific and Technological Achievements was enacted in 2015 in China. It allows universities and research institutions to transfer intellectual properties freely without the burden incurred by administrative procedure of state owned property. However, universities and research institutions can’t build coordinated working process with state owned property administration because relevant governance rules are not enacted timely by national ministries to be in line with the transfer regulation, which results in the delay of the transfers. From the perspective of research management and regulation standardization, this paper finds there exist problems in the coordination of the state owned property management of universities and research institutions with the overall transfer system in terms of laws and regulations, management systems and legal responsibilities. The paper proposes amending the current state owned property management system, focusing on the enforcement of the regulation of Promoting the Transfer of Scientific and Technological Achievements.
