| 网络表情作为证据使用已经为司法实践所确认，并且相关案件数量呈稳定上升的趋势。然而，当前网络表情证据的运用存在若干困境，主要是没有明确作为证据的网络表情的类型，网络表情证据的语言性质和证据性质不明确，对网络表情意义的理解缺乏语言学理论的指导。“九步法”审查路径不能直接应用于我国的司法实践，对网络表情证据的审查还需要明确区分网络表情证据的表情类型和证据类型，并在会话结构中考察网络表情证据的意义和发送行为本身的意义。 |

| The use of online emotion as evidence has been confirmed by judicial practice, and the number of related cases shows a steady upward trend. However, there are a number of dilemmas in the practical applications of online emotion evidence at present, mainly because there is no clear type of online emotion as evidence, the linguistic nature and evidence nature of online emotion evidence are not clear, and the understanding of the meaning of online emotion lacks the guidance of linguistic theory. The “nine step” review path cannot be directly applied to Chinas judicial practice. It is also necessary to clearly distinguish the emotion type and evidence type of internet emoticon evidence, and examine the meaning of internet emoticon evidence and the meaning of sending behavior itself in the conversation structure. |
