| 算法可以通过优化政府治理决策的一致性、透明性、中立性和理性化，提升政府治理的法治化水平。但算法嵌入政府治理还会带来正当程序制度被虚置、民众权利空间被压缩、政府治理权力被商业算法平台俘获、弱势群体被歧视、相关责任难以合理分配等法治风险。在应对法治风险时，应遵循技术、伦理、法治方案多元共治原则，公权力、平台权力、个人权利相平衡原则以及浮动的比例原则。在具体方案上，应当构建清单制度以明确算法嵌入政府治理的应用领域；完善算法解释制度、弱势群体保护制度、算法审查制度以提升算法决策的公正性和可信赖性；积极保障民众的知情权、参与权、平等权以及获得专家帮助权等权利以应对治理权力被不当行使的风险；将政府治理部门作为担责主体从而提升责任分配方案的合理性。 |

| Algorithms can improve the law.based governance of government by optimizing the consistency， transparency， neutrality and rationality of governmental governance decisions. Nevertheless， embedding algorithms into government governance also triggers legal risks， including the hollowing.out of due process，the shrinking of citizens’scope of rights，the capture of governmental governance power by commercial algorithmic platforms，discrimination against vulnerable groups，and difficulties in reasonable allocation of liabilities. To address such legal risks，we should adhere to the principles of multi.governance integrating technology，ethics and the rule of law，the balance among public power，platform power and individual rights，and the flexible principle of proportionality. In terms of concrete measures，a list system shall be established to clarify the application scope of algorithms in government governance. The algorithmic explanation system，vulnerable group protection system and algorithm review system shall be improved to enhance the fairness and credibility of algorithmic decision.making. Citizens’ rights to know，to participate，to equality and to access expert assistance shall be effectively guaranteed to cope with risks arising from improper exercise of governance power. Governmental authorities shall be identified as liability subjects so as to realize a reasonable liability allocation mechanism. |
